A Fairland man has been booked on felony charges of rape and incest after law enforcement officials say he had an inappropriate relationship with a family member.

According to a probable cause affidavit filed in Superior Court I, between the dates of June 15, 2013, and Aug. 30, 2013, Steven Manley did knowingly or intentionally have sexual intercourse with a subject who was compelled by force or imminent threat of force and did engage in intercourse with another person who is biologically related to him.

According to a report from the Shelby County Sheriff’s Department, officials learned of the offenses when a CASA volunteer notified officers of a suspected child molestation when a paternity test disclosed a different father than believed.

During the investigation, a case manager with the Department of Child Services told police that the victim delivered twins earlier this year, and that a paternity test was done and resulted in a zero possibility that the victim’s boyfriend was the father.

When questioned by DCS, the victim told police that she had been raped by a family member.

Officers then interviewed Manley, who denied being the father of the children.

“I asked Manley if he would submit to DNA testing, after several seconds, he replied, I’d rather not,” the report states.

Officers took two oral swabs from Manley, the victim and the child. According to forensic testing conducted at the Indiana State Police Laboratory, the results showed that Manley cannot be excluded as the biological father of the baby. The report states the probability of paternity is 99 percent.

According to court records, Manley’s bond was set in the sum of $30,000 surety, which was posted on Sept. 26.
